Sun and Sea s.r.o, IČO: 12345678, with registered office in Prague 13, Czechia, Kurzova 2222/16, 15500, entered in the commercial register by the Municipal Court in Prague under no. B 26756 (hereinafter referred to as “Sun and Sea”), within the scope of its legal license, is obliged to process your personal data in order to fulfill legal and contractual obligations related to the implementation of the tour.
As an administrator, Sun and Sea places great emphasis on the protection of personal data, whether from the point of view of their confidentiality, integrity or availability. For this purpose, Sun and Sea has developed a security project for the protection of personal data, which contains all organizational, personnel, technical and legislative requirements necessary for the protection of personal data. An integral part of the project is also a clear definition of safe handling of personal data in printed and electronic form. Sun and Sea processes personal data to the extent necessary to fulfill its legal and contractual obligations and at the same time to ensure the best and highest quality services to its customers. Sun and Sea processes personal data in accordance with generally binding legal regulations, in particular with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons in connection with the processing of personal data and on the free movement of such data and on the repeal of the directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as “GDPR”).

What is meant by personal data

Subject of personal data
The subject of personal data is any natural person to whom the subject personal data relates.
If a user of the Sun and Sea website under the age of 16 wants to give consent to the processing of his personal data through the website, this consent must be expressed or approved by the person who exercises parental responsibility for this user.
Categories of personal data that Sun and Sea processes about you
Sun and Sea processes only those data that are necessary for the purposes further specified in this document.
In particular, this applies to the following categories of personal data:
- identification data (e.g. title, first name, last name, date of birth);

furthermore, Sun and Sea also processes other data that is transferred to it or that it collects in connection with the provision of agreed services, if this is necessary to fulfill the purpose for which it is provided (e.g. data on travel documents).
In this context, Sun and Sea informs you that it is not your legal obligation to provide personal data, but from the logic of the matter it is not possible to conclude a tour contract or fulfill any obligations arising from it without providing personal data and consent to their processing. However, consent to the processing of personal data for the purpose of marketing is not a condition for concluding a tour contract.
Legal basis for personal data processing
Sun and Sea is authorized to process personal data based on the following legal bases:
- An accommodation contract or other contract including air carriage contracts;
- Legitimate interest, which is the protection of the rights and legitimate interests of Sun and Sea and its customers, internal records and control;
- Fulfillment of legal obligations arising in particular from Act No. 89/2012 Coll., Civil Code, Act No. 634/1992 Coll., on consumer protection, Act No. 235/2004 Coll., on value added tax, Act No. 563/1991 Coll., on accounting, Act No. 253/2008 Coll., on certain measures against the legalization of proceeds from criminal activity and the financing of terrorism;
- Consent of the data subject.
Legal basis for personal data processing
Sun and Sea processes personal data on the basis of the aforementioned legal reasons in particular:
- For the purpose of fulfilling and exercising the rights and obligations arising from the tour contract, when, for example, these specific activities are involved:
– Booking accommodation;
– Provision of performance according to the booking contract for customers within the provision of tourism services;
– Providing performance according to the tour contract for VIP customers;
– Ticket booking and customer check-in at the airport, including transfer to the airport and management of the airport branch;
– Claims procedure;
For this purpose, the following categories of personal data are processed:
Name, surname, date of birth, telephone number, email address, address, country of issue of the travel document, or description of health status - For the purpose of fulfilling legal obligations, when, for example, these specific activities are involved:
– Obtaining an audit check and preparing a tax return;
– Registration of documents in the company’s accounting and subsequent realization of payments and other business transactions.
For this purpose, the following categories of personal data are processed:
Name, surname, date of birth, telephone number, email address, address, country of issue of the travel document, or description of health status - In order to protect the rights and legally protected interests of Sun and Sea, when, for example, these specific activities are involved:

– Offer of products and services provided by Sun and Sea and cooperating third parties, including through electronic channels;
– Marketing processing, analysis and profiling with the aim of adapting the Sun and Sea offer to your needs and improving the quality of the services provided.

Sun and Sea uses technical, marketing and analytical tools on its website so that it can ensure the operation of services, make your visit to the website more pleasant and improve Sun and Sea services.
The website www.sunsea.uk stores ” Cookies ” files (small files stored on your computer), which are normally used to anonymously distinguish individual users.
Sun and Sea helps in providing the basic functionalities of this site, including the verification of content necessary for the provision of comprehensive tourism services, enables the analysis of the way the site is used and the performance of sales channels, personalizes the content of advertising messages on and off the site.
The data generated by the cookie about the use of the site (including your IP address) will be processed anonymously without providing personally identifiable information. The data is intended exclusively for evaluating the use of the website.
Some cookies make it possible to collect information that is subsequently used by third parties and that, for example, directly support Sun and Sea’s marketing activities (so-called “third-party cookies” ). If you are logged in to a social network service provider at the time the plugin is activated, this provider is able to determine your behavior on the website based on the above data. Please note that this data may also be processed by the provider in countries outside the European Union. Sun and Sea has no influence on the scope, manner and purpose of data processing by the provider. Transfer of personal data
Personal data are transferred mainly to business partners who ensure the implementation of the agreed services based on the booking contract. These include airlines, airports, accommodation facilities, partners in the destination, sales representatives mediating the sale of Sun and Sea rentals and services, ERV insurance company and others.
In addition, personal data may be provided in the event of the purchase of other services through Sun and Sea to providers of these services as administrators of this personal data, in particular ERV and parking lot operators.
Furthermore, your personal data may be transferred to the necessary extent to processors for the purpose of fulfilling legal obligations and protecting the interests of Sun and Sea, tax advisors, auditing companies and lawyers, as well as entities providing technical support.
Based on the legitimate interest of Sun and Sea, your personal data may be shared within the holding for internal administrative purposes.
Sun and Sea also points out that personal data may further be provided to a public authority, to the extent and under the conditions set by generally binding legal regulations.
Transfer of personal data outside the EU
The personal data that Sun and Sea obtains and processes for the purpose of implementing the tour contract is provided to partners ensuring the implementation of the agreed services (as listed in point 7), and depending on the destination, these may be partners in countries within the EU, but also outside the EU, or outside the European Economic Area.
Time of personal data processing
Sun and Sea processes personal data only for the time that is necessary for the purpose of their processing and for the time required by law. Personal data obtained on the basis of a tour contract or other similar contract will be processed for a period of 10 years, and personal data obtained on the basis of consent for the purpose of marketing will be processed for a period of 5 years.
Rights of the data subject
The data subject has the right to free information regarding the processing of his stored personal data.
Subject to compliance with the requirements set out in generally binding legal regulations, the data subject also has:
- the right to access your personal data;
- the right to correct incorrect personal data;
- the right to restrict (block) the processing of personal data;
- the right to object to the processing of your personal data for this purpose;
- the right to delete personal data, especially if they are no longer needed for the purposes for which they were obtained or otherwise processed or if he has withdrawn his consent to their processing and if there is no other legal basis for processing, or if personal data is processed illegally;
- the right to data portability, i.e. the right to obtain your personal data, which Sun and Sea has voluntarily provided, in electronic form, in a structured, commonly used and machine-readable format, and in this context you can exercise your right to transfer this data to another administrator, if such transfer is technically possible (right to data portability);
- the right to file a complaint with the supervisory authority, which is the Office for the Protection of Personal Data of the Czech Republic, Plk. Sochora 27, 170 00 Prague 7, upon suspicion that his personal data is being processed in violation of applicable legislation.
In the event that the data subject exercises some of the rights of the data subject at Sun and Sea according to the legal regulations governing the protection of personal data and the identity of the applicant cannot be verified from the request of the data subject or in the event that Sun and Sea has legitimate doubts in connection with the identity of the person who submits request, Sun and Sea reserves the right to ask that person to provide additional information needed to confirm the identity of the person making this request.
